

Proposed Changes to the Trade Waste Bylaw 2013

After a review, Council has suggested some changes to make the bylaw more effective and improve understanding of how it regulates trade waste. Auckland Council sought feedback on the new proposed Trade Waste Bylaw and Business East Tamaki made a submission to ensure these changes will not result in new significant requirements for businesses.
Our submission raised the concern that if all businesses were subject to the Bylaw, then the rules relating to low risk dischargers needed to be very clear to avoid these kinds of businesses having to meet higher restrictive standards. The adopted Bylaw will now clarify that unavoidable discharge of rainwater into trade waste systems from low risk businesses does not require a trade waste agreement. New definitions have been added for clarification and completeness. Additional related information will be included in the Bylaw to better inform low risk business dischargers. Further, the grounds for varying a trade waste agreement have been clarified.
